How Japan Overtime Pay Works (残業代の計算方法)
Japan’s overtime pay system is governed by the Labor Standards Act
(労働基準法). The legal limit for regular work is 8 hours per day and
40 hours per week. Any work beyond these limits must be compensated at
a minimum of 1.25× the regular hourly rate. Your
hourly rate is calculated by dividing your monthly salary by your
scheduled monthly working hours — typically 160–176 hours depending on
your contract.
Late-night work between 22:00 and 05:00 carries an additional premium,
bringing the effective rate to 1.50× when combined with
overtime. Work on statutory holidays (法定休日 — generally one day per
week guaranteed by law) is paid at 1.35×, or
1.60× if it also falls in late-night hours. Since April
2023, overtime exceeding 60 hours per month must be paid at
1.50× for all companies.
36 Agreement and Overtime Caps (三六協定)
To legally require overtime work, employers must have a written
36 Agreement (三六協定, san-roku kyōtei) in place,
filed with the Labor Standards Inspection Office. Under Japan’s 2019
Work Style Reform rules, standard overtime is capped at 45 hours/month
and 360 hours/year. In special circumstances (繁忙期), this can be
extended to 100 hours/month and 720 hours/year, but 80h/month average
and 100h single-month caps apply.
